§ 3.3.015. Amendments.

  • Notwithstanding the provisions of Section 3.3.005, Sections 10.20.030, 10.20.038, 10.20.120.B, 10.20.185, 10.28.020, 10.28.160, 10.28.061.A, 10.90.010.I.A.9, 10.90.010.I.B.5, 10.90.010.I.B.6, 10.90.010.I.C.3 and 10.90.010.I.C.4 and Part 4 of Chapter 10.20 of Division 1 of the Animal Control Ordinance are hereby amended as follows:

    A.

    Section 10.20.030 (License — Required — Costs) is hereby amended to read as follows:

    "10.20.030 License — Required — Costs.

    Every person owning or having custody or control of any dog or cat over the age of four months in the City shall obtain an annual license from the director for each dog and cat and shall pay the fee for the licenses including delinquency charges as set forth in Sections 10.20.120 and 10.90.010."

    B.

    Section 10.20.038 (Residential dogs and cats — Limitations) is hereby amended to read as follows:

    "10.20.038 Residential dogs and cats — Limitations.

    A combined total of up to four dogs and cats may be kept at any residence without an animal facility license, provided the dogs' and cats' owner or custodian licenses each individual dog and cat. For purposes of this section, a service dog licensed under Section 10.20.090, is not counted toward the number of dogs kept or maintained, while such dog is serving a person who is mentally or physically disabled within the meaning of Government Code Section 12926(i) or Government Code Section 12926(k)."

    C.

    Section 10.20.120.B is hereby amended to read as follows:

    "B. A delinquency charge as provided in Section 10.90.010 shall be assessed when, in violation of the provisions of this chapter, the license fees provided for in this chapter are not paid within ten days after the expiration date or the date the license is required to be obtained by the provisions of this title."

    D.

    Section 10.20.185 (Microchipping of dogs required) is hereby deleted.

    E.

    Part 4 (Mandatory Spay and Neuter Program for Dogs) of Chapter 10.20 (Dogs and Cats) of Division 1 (Animal Control) of Title 10 (Animals) is hereby deleted.

    F.

    Section 10.28.020 (Initial license — Application required) is hereby amended to read as follows:

    "10.28.020 Initial license — Application required.

    Every person desiring a license to operate an animal facility or to keep a wild animal under Section 10.28.060, shall file an application with the department upon a form to be provided by the department, and at such time pay the required fee and any applicable penalty for any violation of this chapter as set forth in Section 10.90.010.II, including, without limitation, delinquency charges. A person who possessed or owned a wild animal or who operated an animal facility without the required license, shall pay the penalty set forth in Section 10.90.010.II.C.4, in addition to the license fee. When a person applies for licenses for different purposes for animals at the same premises at the same time, the cost of the licenses shall be reduced by the amount set forth in Section 10.90.010.II.A.3."

    G.

    The second sentence of Section 10.28.160 (Renewal procedure) is hereby amended to read as follows:

    "When a person applies for more than one renewal, for animals at the same premises at the same time, the cost of the renewals shall be reduced by the amount set forth in Section 10.90.010.II.B.3."

    H.

    Section 10.28.061.A. is hereby deleted.

    I.

    Sections 10.90.010.I.A.9, 10.90.010.I.B.5, 10.90.010.I.B.6, 10.90.010.I.C.3 and 10.90.010.I.C.4 are hereby deleted.

    J.

    The individual animal license fees identified in Sections 10.90.010.I.A.1, 10.90.010.I.A.2 and 10.90.010.I.A.4 of the Animal Control Ordinance shall remain as set forth in Section 58 ("Individual Animal Licenses) of Los Angeles County Ordinance No. 2000-0075 (adopted December 19, 2000), adopted by reference as the Animal Control Ordinance of the City of Westlake Village on January 1, 2001.
